These Terms of Service (the “Terms”) govern your access to and use of Inkdeck (the “Service”), operated by THE AGILE MONKEYS S.L.(“we”, “our”, “Inkdeck”), with registered office at Calle Canalejas 80 5ºC, CP 35003, Las Palmas de Gran Canaria, Las Palmas, Spain (Spanish Tax ID B76229087). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Inkdeck is an online tool that turns source text (such as a meeting transcript or document) into structured, editable slide decks and rendered slide images, which you can refine and export as a PDF. The Service is offered free of charge for personal and professional use, subject to the reasonable-use rules described below. We may, at our sole discretion, introduce paid tiers in the future; if we do, the current free tier or its equivalent will continue to be available unless we notify you otherwise.
2. Eligibility and accounts
You must be at least 16 years old to use the Service. By creating an account you represent that you meet this requirement and that the information you provide is accurate. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us promptly at info@theagilemonkeys.com if you suspect unauthorised use of your account.
You may sign in using an email and password, or by using “Continue with Google”. When you sign in with Google, you authorise Google to share your profile name and email address with us as described in our Privacy Policy.
3. Acceptable use
Free use of the Service is permitted within reasonable limits. You agree not to:
- Use the Service to generate, store, or distribute content that is illegal, infringing, defamatory, harassing, hateful, sexually explicit content involving minors, or that incites violence.
- Submit personal data of third parties without a lawful basis to do so, or submit data you do not have the right to process.
- Attempt to bypass, disable, or interfere with rate limits, per-account quotas, content-safety moderation, authentication, or any other security or integrity mechanism of the Service.
- Use automated means (bots, scrapers, headless scripts) to access the Service beyond what is necessary for normal interactive use, or to create multiple accounts in order to circumvent quotas.
- Resell, sublicense, or commercially redistribute the Service itself or access to it. (You are, of course, free to use the decks you generate however you wish, subject to applicable law and to the terms of our AI subprocessors.)
- Use the Service to train, fine-tune, or benchmark a competing AI model, or to systematically extract its prompts or outputs for that purpose.
- Reverse engineer, decompile, or otherwise attempt to derive the source code or underlying models of the Service, except to the extent that this restriction is prohibited by applicable law.
“Reasonable use” means use that is consistent with how a typical individual user would interact with the Service interactively from a browser. We publish per-account quotas inside the application; staying within those quotas is a good proxy for reasonable use.
4. Your content
You retain all rights in the source text you submit and in the slide content you produce with the Service (collectively, “Your Content”). You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, transmit, and display Your Content solely to the extent necessary to operate the Service for you (for example, to generate slide outlines, render images, assemble PDFs, and back up your decks).
We do not use Your Content to train any AI model — neither ours nor any third party’s. See our Privacy Policy for the contractual arrangements that back this commitment.
You are solely responsible for Your Content and for ensuring that you have all rights necessary to submit it to the Service and to use the outputs generated from it.
5. AI-generated output
The Service uses third-party large language models and image generation models to produce slide outlines and images from your inputs. AI-generated output may be inaccurate, incomplete, biased, or otherwise unsuitable for your purposes. You are responsible for reviewing all output before relying on it, sharing it, or making decisions based on it. The Service is not a substitute for professional judgement, legal, medical, financial, or other expert advice.
Because of the nature of generative models, similar inputs may produce similar outputs across users. We make no representation that any output is unique to you, and we accept no responsibility for the use you make of it.
6. Suspension and termination
We may suspend or terminate your access to the Service, with or without prior notice, if we reasonably believe that you have breached these Terms, that your use poses a risk to the Service or to other users, or that we are required to do so by law. In particular, accounts that abuse the Service — including by exceeding reasonable use, circumventing quotas, using automated access patterns, or submitting prohibited content — may be suspended or permanently banned at our discretion.
You may stop using the Service at any time. To delete your account and associated data, email info@theagilemonkeys.com with a deletion request from the address registered on your account; this is the same erasure right described in our Privacy Policy. We will action the request within one month, subject to any lawful retention requirements.
Sections that by their nature should survive termination (including sections 4, 7, 8, 9, 10, and 11) will continue to apply after your account ends.
7. Availability and changes to the Service
We aim to make the Service generally available 24/7 but we do not guarantee uninterrupted or error-free operation. Maintenance, updates, capacity constraints, third-party outages, and force-majeure events may cause downtime or degraded performance.
We may add, change, or remove features at any time, and we may change or discontinue the Service in whole or in part. Where reasonably practicable we will give advance notice of material changes inside the application.
8. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy of output, uninterrupted availability, and freedom from errors, viruses, or other harmful components. We make no guarantee that the Service will meet your requirements or that any output will be accurate, complete, lawful in your jurisdiction, or suitable for your intended use.
Nothing in this section limits any non-waivable consumer rights you may have under mandatory Spanish or EU law.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event will we, our affiliates, or our subprocessors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or substitute services, arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
Because the Service is offered free of charge, and to the maximum extent permitted by applicable law, our aggregate liability to you in connection with the Service is limited to fifty euros (€50). This limitation does not apply to liability that cannot be excluded or limited under mandatory law (including for fraud, gross negligence, or wilful misconduct).
10. Indemnity
You agree to indemnify and hold harmless THE AGILE MONKEYS S.L. and its officers, employees, and contractors from and against any third-party claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) Your Content, (b) your use of the Service in breach of these Terms, or (c) your violation of any applicable law or of the rights of a third party.
11. Governing law and jurisdiction
These Terms are governed by the laws of Spain, without regard to its conflict-of-laws rules. Any dispute arising out of or in connection with these Terms or the Service shall be submitted to the Courts and Tribunals of Las Palmas de Gran Canaria, Spain, except where mandatory consumer-protection law grants you the right to bring proceedings in the courts of your place of residence.
If you are a consumer resident in the European Union, you may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
12. Changes to these Terms
We may update these Terms from time to time. The “last updated” date at the top of this page reflects the most recent revision. Material changes will be highlighted on the Service before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
13. Miscellaneous
These Terms, together with the Privacy Policy, the Legal Notice, and the Cookie Policy, constitute the entire agreement between you and us regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
